民法典中融资租赁登记制度立法研究

According to judicial statistics, in recent years, financial leasing disputes have shown an increasing trend in China. Among them, the number of disputes arising from the disposal of leased property by the lessee in good faith and disputes over the actual borrowing of funds in the name of financial lease is the majority. At present, due to the lack of perfect relevant legal provisions, especially the lack of provisions on the publicity method of financial leases, the protection of the rights of the financiers is not effective, which affects the security of funds and the healthy development of the financial leasing industry. At the time of the compilation of the Civil Code, it is not only necessary but also feasible to establish a financial lease registration system. This paper puts forward a legislative conception for the financial lease registration system from the aspects of basic principles of financial lease registration, registration subject, authority, content, review, and third-party inquiry obligation.
