Abstract
Discusses the proposal to develop a Protocol to the Hague Convention on the Civil Aspects of International Child Abduction 1980 containing auxiliary rules to improve its operation, including: (1) the background to the proposal; (2) the rationale for a Protocol rather than a soft law alternative; (3) the possible scope of the Protocol; (4) the need for it to clarify the distinction between rights of custody and access; (5) the need for additional measures in relation to the welfare of returned children and primary carers where the abductor is the primary carer; and (6) some possible procedural reforms. © 2011 Sweet & Maxwell
