'Hypothetical facts' and the balance of probabilities

    Abstract

    The law of clinical negligence rests on the civil law test of ‘the balance of probabilities’. This is different to the criminal law standard of proof which is ‘beyond reasonable doubt’. In other words, civil claims are decided on whether there was more or less than a 50% chance of something being the case.
