Abstract
Discusses the range of possible legal remedies open to neighbours of privately owned residential properties that have been abandoned or allowed to fall into a state of disrepair. Considers key issues such as the role of the Housing (Scotland) Act 2006, the treatment of tenement property, the use of planning law, the applicability of the law of nuisance, delictual claims, and property law aspects such as whether neglect can constitute "material detriment" for the purposes of the Title Conditions (Scotland) Act 2003.
