Negotiation and Legal Education

Research output: Chapter in Book/Report/Conference proceedingChapter

Abstract

Given that lawyers are tasked with helping clients resolve their legal issues, it is vital that students as future lawyers become adept in dealing with different forms of dispute resolution. The current ways of resolving legal problems are diverse, ranging from non-litigation settlements between the parties to settlements involving litigation through the court system. The ability to negotiate effectively is an essential skill for a lawyer. Negotiation skills are not only used when dealing with opposing parties, but they are also required when dealing with others, such as colleagues and clients. Negotiation skills now form an integral part of legal education. These skills are taught through, for example, standalone courses, pervasively being incorporated into different courses using role-play and simulation, and through extra-curricular activities such as competitions. There are many styles of negotiation and students will learn how they can adapt their approach according to the situation and party.
