Abstract

The chapter addresses the question whether a policy framework implementing commitments made under the Paris Agreement on climate action is compatible with pre-existing obligations arising from treaty and contractual instruments. It examines this possible tension in relation to new kinds of energy or energy-related activity that have generated disputes between international investors and states, and considers the notion of 'legitimate expectations' in this context of legislative actions by states to implement their commitments.
