Abstract

This report presents the results of a research project on the situation of LGBTI+ people in deprivation of liberty in Brazil. The research involved 20 in depth semi-structured interviews with LGBTI+ people with life experience in the prison system; human rights defenders; public actors; and representatives of the National and State Mechanism for the Prevention and Combat of Torture.
The project was carried out as part of a partnership between the Maria institute and Joao Aleixo, the Favelas Observatory and the University of Dundee. The research received financial support from Global Challenges Research Funding/Scottish Funding Council.
The project dialogues with other studies conducted in India (Gosh, et al, 2020) and the UK (Fernandes, Kaufmann and Kaufmann, 2021) under the coordination of the University of Dundee. The general purpose of these initiatives was to understand the reality of LGBTI+ people in the prison systems of each country and to build international dialogue agendas, in which the I International Seminar on LGBTI+ People in Deprivation of Liberty, held in Rio de Janeiro in 2019, consolidated a first step in this direction. The focus of the research project was to contribute to the production of knowledge on this theme, which still has little presence, both in Brazilian and international literature. In fact, only over the last decade there has been greater attention, whether in written production or in the formulation of national and international policies and regulations, for the theme of LGBTI+ people in deprivation of liberty. Brazil is located, at the international level, as a country marked by systematic human rights violations, both in the prison system and with the LGBTI+ population. The racial and territorial dimensions are present in a strong way in the dynamics of these violations, with afrodescendants from popular territories being the main victims. In fact, analysing the theme of LGBTI+ people in deprivation of liberty puts us in the challenge of understanding the historical legacies of oppression that mark Brazilian society and the complexity of the convergences between these dimensions that mark the experiences of LGBTI+ people in the prison system. Our project acquires, thus, a political centrality, understanding that a theme so sensitive to Brazilian society requires greater attention and visibility. It intends to contribute to policy agendas for human dignity, expanding reflections and initiatives that articulate human rights in the prisons and human rights of LGBTI+ people.
