Pessoas LGBTI+ em privação de liberdade: rumo a agendas participatórias e inclusivas de pesquisas e políticas nas periferias globais. Uma perspectiva do Brasil e da Índia

Deprivation of liberty constitutes a challenge to the protection and implementation of the human rights of those who are under the custody of the State. The widespread knowledge that human rights violations have been perpetuated in prisons and other forms of institutional confinement constitutes a challenge that involves not only the design and effective implementation of policies, but also the overcoming of stigma and stereotypes that monsterise the prison population and, by extension, sustain representations and practices that contribute to the perpetuation of the violation of human rights. With regard to the LGBTI+ population in prisons, the challenge seems to be even more complex, because it involves groups whose identity carries with it additional marks of prejudice and discrimination, which tend to be intensified in the microcosm of the relations established in the context of deprivation of liberty. In fact, it is extremely necessary to mobilise, in a combined effort, the different sectors of society that have historically fought for the guarantee and promotion of human rights of people deprived of liberty as well as LGBTI+ campaigns. The construction of an interfaced mobilisation between the deprivation of liberty and LGBTI+ is an urgent work front that should involve the production of research that supports the work of advocacy and social mobilisation. The recent challenges faced by LGBTI+ people through a renewed wave of religious and political conservatism in Brazil, and societal as well as institutionalised persecution in India, and internationally, give us a warning sign of the relevance of the issue of LGBTI+ incarceration, and the multiple dimensions of its criminalisation that are result of a confluence of historical socio-political systems of oppression that are related to race, ethnicity, religion, class and caste structures as well as socio-territorial origin.
