    Abstract

    This is the first book on prisons law in Scotland. Due to the increasing involvement of domestic courts and the European Court of Human Rights in prison matters, changes in penal philosophy and the period of prisoner unrest in Scotland in the mid 1980s, the law has come to play a much more significant role in prisons. Under the old dispensation, the rule of law effectively ended at the prison gate; in the new, it forms the basis of the philosophy of "Opportunity and Responsibility", the Scottish Prison Service's main policy document on imprisonment.
