    Abstract

    Fully revised and updated from the first edition, to take into account the Act of Sederunt (Small Claim Rules) 2002, Small Claims Handbook, Second Edition is an invaluable guide to the small claims procedure. The small claims procedure was introduced into the sheriff courts in Scotland in November 1988 as a simple, quick, informal and inexpensive method for settling disputes where the claim is worth up to GBP750.00. Although this scheme encourages litigants to act for themselves, in practice, many do not and legal professionals are frequently involved. This book describes the background of the scheme and comprehensively deals with its operation and procedures. All relevant primary and secondary legislation is included, not only the small claim rules themselves but also the ordinary and summary cause rules which apply to small claims.
