Abstract
This offers both a description and critique of Scottish criminal procedure. It explains the principles and practices of the criminal process and what it is that this process intends to achieve. Its starting point is when a person is suspected of committing a criminal offence or offences, and considers police powers, the prosecution process, alternatives to prosecution, pre-trial issues, the trial, burdens and standards of proof, and verdicts, as well as the role of the accused, judges, juries, defence agents, complainers (victims) and other witnesses.
